Terms and Conditions

Embroidax is an embroidery digitizing service converting artwork, logos, and images into stitch-ready embroidery files for small embroidery shops, hobbyists, clothing brands/wholesalers, and print-on-demand businesses. Embroidax is not a registered company; it is operated as a sole proprietorship by its founder, based in Pakistan.

We provide digitizing for, among other things:

• Left chest logos
• Caps, hats, and 3D puff embroidery
• Jacket backs, hoodies, and large-format placements
• Portraits and pet images
• Related services such as patch digitizing, vector art conversion, appliqué, and puff embroidery

Digitized files are delivered in the machine format(s) you request at checkout or specify in your order (e.g., DST, PES, EXP, JEF, and other common formats), at no extra charge.

• Orders may be placed through the Site, via WhatsApp, or by email, and are confirmed once payment is received.
• You are responsible for providing clear, accurate artwork and specifications (design type, size, machine format, color count, and any special techniques). Delays or errors caused by unclear or incomplete files/instructions are not the responsibility of Embroidax.
• Pricing is as shown on our Site's pricing page at the time of your order, or as otherwise quoted to you directly (including custom quotes for complex or non-standard work). All prices are listed and charged in US Dollars (USD).

• Payment is collected through PayPal, which also allows payment by major debit/credit cards, in USD.
• Full payment is required before work begins, unless otherwise agreed in writing (e.g., for an approved custom/negotiated order).
• For monthly plans (Basic, Standard, or similar), payment covers the design allowance for that billing cycle.

• We aim to deliver most standard designs within 24 hours of order confirmation. This is a best-effort target, not a guaranteed deadline, and actual turnaround can vary with order complexity, volume, and the completeness of the information/artwork you provide.
• Missing the 24-hour target does not, by itself, entitle you to a refund, discount, or credit. See our separate Return & Refund Policy for the limited situations where a refund does apply.

• Minor revisions (e.g., small size, placement, thread color, or minor stitch adjustments) to a delivered design are free and unlimited, provided the request stays within the original order specifications.
• Major changes — such as a substantially different design, a full redesign, changes to the artwork itself, or requests that fall outside the original brief — are treated as new work and may be charged separately. We'll let you know before any extra charge applies.

• If you cancel before digitizing work has started, you'll receive a full refund.
• If you cancel after work has started but before delivery, you'll receive a refund of the order amount minus a small processing fee to cover work already completed.
• For monthly plans, you may cancel at any time. Any unused design allowance for the current billing period is forfeited upon cancellation and is not refunded or carried over.

• Once a design is paid for in full, ownership of that specific digitized file transfers to you, the Client. You're free to use it for your own commercial or personal purposes.
• Embroidax reserves the right to display completed work (e.g., in our portfolio, case studies, or marketing) unless you specifically opt out. To opt out of a design being shown publicly, email us at embroidaxteam@gmail.com and we will honor your request.
• Files are provided for your use; the underlying digitizing techniques, templates, and internal processes used to create them remain Embroidax's own know-how and are not transferred.

You confirm that you own, or have the right to use, any artwork, logo, image, or design you submit to us for digitizing. You agree not to submit artwork that infringes on someone else's copyright, trademark, or other intellectual property rights, or that is otherwise illegal, and you agree to indemnify Embroidax against any claims, damages, or losses arising from artwork you submitted without proper rights.

Order updates, quotes, and support are handled via in-platform messaging, WhatsApp, and/or email. It's your responsibility to respond promptly to requests for clarification, as delays on your end may extend delivery timelines.

To the maximum extent permitted by law, Embroidax's total liability for any claim arising from an order is limited to the amount you paid for that specific order. Embroidax is not liable for indirect, incidental, or consequential damages, including lost profits or lost business, arising from the use (or inability to use) our Services or Site.

We aim to keep the Site and our Services available at all times but do not guarantee uninterrupted access. We are not responsible for delays or failures caused by circumstances outside our reasonable control (e.g., internet outages, third-party payment processor issues, natural events).

We may update these Terms from time to time to reflect changes in our Services or for legal reasons. The updated version will be posted on this page with a revised "Effective Date." Continued use of the Site or Services after changes are posted means you accept the updated Terms.

These Terms are governed by the laws of Pakistan, without regard to conflict-of-law principles. Any disputes arising from these Terms or our Services will first be attempted to be resolved informally by contacting us directly at embroidaxteam@gmail.com.
